1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your access to and use of getclinads.com, app.getclinads.com, and the ClinAds platform (together, the "Service"), provided by 18-17-12, Inc., a Delaware corporation ("Clinsight AI," "we," "us," or "our").
By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you're using the Service on behalf of a clinic or other organization, you're confirming you have the authority to bind that organization to these Terms.
2. Description of the Service
ClinAds is an AI-powered marketing platform for dental, dermatology, med spa, vision, and multi-location clinics. The Service builds a brand profile from your clinic's website, generates and schedules advertising content, and can connect to third-party advertising and social platforms to publish campaigns on your behalf.
Product walkthroughs, demos, and sample figures shown on our marketing pages are illustrative and don't guarantee any particular result for your clinic.
3. Accounts & Eligibility
You must provide accurate, current information when creating an account and keep it up to date. You're responsible for maintaining the confidentiality of your login credentials and for all activity under your account. The Service is intended for business use and is not directed to individuals under 18.
4. Subscriptions & Payment
Certain features of the Service require a paid subscription. By subscribing, you authorize us to charge your chosen payment method on a recurring basis until you cancel. Fees are billed in advance and, except as required by law or stated otherwise at signup, are non-refundable.
Any advertising spend you authorize through connected ad accounts is separate from your subscription fee and is billed by the relevant advertising platform or through your connected payment method.
5. Connected Platforms & Website Data
When you provide your clinic's website URL, you authorize us to retrieve publicly available assets from it, including your logo, colors, fonts, photos, listed services, and audience information, in order to build your brand profile and generate content.
When you connect third-party accounts (such as Meta, Instagram, TikTok, or Google) to publish or manage campaigns, you're subject to those platforms' own terms and policies, and you authorize us to access and act on those accounts as needed to provide the Service. We aren't responsible for the availability, accuracy, or policies of third-party platforms.
6. Your Content & Generated Content
You retain ownership of the website content, brand assets, and materials you provide to the Service ("Your Content"). You grant us a license to use Your Content to operate and provide the Service, including to generate ads and campaigns on your behalf.
Ads, copy, and creative generated through the Service ("Generated Content") are made available to you for use in your clinic's marketing, subject to these Terms. Because Generated Content is produced with AI assistance, we don't guarantee it's error-free, unique, or fit for every purpose, and you're responsible for reviewing it before it's published, including for accuracy and compliance with advertising, healthcare, and platform-specific rules that apply to your clinic.
7. Acceptable Use
You agree not to:
- Use the Service to publish false, misleading, or deceptive advertising, including unsubstantiated medical or clinical claims
- Violate any applicable law, including advertising, healthcare, or data protection regulations that apply to your clinic
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to access accounts, data, or systems without authorization
- Use the Service to infringe on the intellectual property or rights of others
8. Intellectual Property
The Service, including its software, design, and underlying technology, is owned by Clinsight AI and our licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights in the Service.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or achieve any particular marketing or business result.
10. Limitation of Liability
To the maximum extent permitted by law, Clinsight AI won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.
11. Indemnification
You agree to indemnify and hold Clinsight AI harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, Your Content, Generated Content you publish, or your violation of these Terms or applicable law.
12. Termination
You may cancel your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, or for other legitimate business reasons, with notice where reasonably practicable. Sections that by their nature should survive termination (including ownership, disclaimers, liability, and indemnification) will continue to apply.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, unless applicable law requires otherwise.
14. Changes to These Terms
We may update these Terms from time to time. We'll post the revised version here and update the "Last updated" date above. Continued use of the Service after changes take effect means you accept the updated Terms.
